General conditions

This document, together with the documents mentioned in it, establishes the conditions by which the use of the website www.WillyPadel.com (from now on, the Web) and the purchase of products in it (from now on, the Conditions) are regulated. By using this website or placing an order through it, you agree to be bound by all the conditions described in the legal section of the website so if you do not agree with all the conditions set out, you should not use this website.

These Terms may be modified. It is your responsibility to read them periodically, as those in force at the time of placing orders or failing that, at the time of use of the website, will apply.

Use of the website

This website is intended for the online sale of products and services and will be governed by the conditions that appear in the legal section of this website.

All products appearing on the website are available for sale except those subject to limited stocks, offers, etc..

It may happen that there are breaks in stock due to mass purchases and that for operational reasons this situation is not reflected correctly on the website, so the delivery time may be delayed, as reflected in the delivery conditions

Guarantees

The legal guarantee of the products offered by Willy Padel is the one established in the Royal Legislative Decree 1/2007, of November 16th. For any claim related to the guarantee of the product the customer must notify its dissatisfaction within 30 days

The legal guarantee of the personalized products will be limited according to the support, personalization technique, use and quality. At all times the client will be able to see the average warranty of the customization through the available technical data sheets. If you consider that the quality or guarantee of your customization is not what you expected you can send an email to: hola@Willy Padel.com reporting the situation of dissatisfaction

Orders and availability

All orders are subject to product availability. If at the time of issuance of the order we detect that there is no stock in our stores of any of the products included in it, Willy Padel will try to locate the garment. If this is not possible, the customer will be notified immediately. In addition, the amount of the article collected and not sent will be paid in the following days to the client, by the same means of payment used in the purchase.

Possibility of discount voucher for the item that we do not have availability plus gift percentage

We control our stocks daily, but we can have errors, (last minute stock break) and therefore, Willy Padel offers all customers the offer to validate the item(s) that we are unable to serve, exchanging them for a bonus benefit “without expiration” plus an additional 3% to the amount not served.

Willy Padel may cancel any order or not accept a confirmed order for the following reasons:

In case of a technical error and / or a typographical error in the prices or other data of the products contained on the website when the order was placed.

Due to unavailability as described in the previous section.
When the security systems indicate that the order may be fraudulent.
For situations in which the order could not be delivered to the address indicated in the order.

In all these circumstances Willy Padel will pay the amount previously paid

Prices and payment

All prices shown on the website are exclusive of VAT

Prices may change at any time, but possible changes will not affect orders for which we have already sent you an order confirmation.

The means of payment will be as follows:

Credit and debit cards through Stripe (Secure Payment)
The security, guarantee and efficiency of payment through electronic platforms will be established by the providers of these platforms

Billing

In accordance with the provisions of Article 68 of Law 37/1992 of 28 December on Value Added Tax, the delivery of the articles will be understood to be located in the territory of application of Spanish VAT if the delivery address is in Spanish territory except for the Canary Islands, Ceuta and Melilla. The applicable VAT rate will be the one legally in force at any given time depending on the specific article in question.

In orders destined for the Canary Islands, Ceuta and Melilla, deliveries will be exempt from VAT by application of the provisions of Article 21 of Law 37/1992, without prejudice to the application of the corresponding taxes and tariffs in accordance with the regulations in force in each of these territories.

You expressly authorize Willy Padel to issue the invoice in electronic form, although you can indicate at any time your desire to receive a paper invoice, in which case, we will issue and send the invoice in that format.

Applicable law and forum

These General Conditions shall be governed by and interpreted in accordance with Spanish law in those matters not expressly established. The parties agree to try to resolve any discrepancies and/or disputes that may arise in relation to this contract through good faith negotiations.

In the absence of an amicable agreement, the parties expressly and voluntarily submit themselves to the courts of Barcelona to resolve any dispute that may arise regarding the interpretation and application of this contract, with the express exclusion of any other jurisdiction that may correspond to them.

Design
It is forbidden to copy, reproduce or disclose without prior consent of the authors of the T-shirts, sweatshirts, accessories, pictures and designs. All designs are copyrighted by their respective owners.
